A lot of wailing and crying going on about the reversal of Roe vs. Wade and the loss of the right to abortions.
I will admit that I am a little confused about all of the fuss. The word “abortion” is not in the U.S. Constitution. At least I couldn’t find it.
Amendment 10 to the Constitution specifically states that “powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively or to the people.” In common English, “the powers not mentioned in this Constitution that aren’t given to the federal government and aren’t forbidden to the states are left to the states and the people.”
If abortion is somewhere hidden or referred to in some other way I can’t find it so it must a state issue.
If it needs to be a national issue, then let’s get an amendment passed. If not, leave it to the states.
In Roe vs. Wade the Judges ruled that laws that prohibited abortion, intruded somehow into a women’s right to privacy.
They referred to the First, Third, Fourth, and Ninth Amendments. They concluded that these amendments implied a right to privacy by virtue of the penumbras of these amendments taken together.
The First Amendment: Freedom of Religion; Freedom of Speech; Freedom of the press; Freedom to assemble; Freedom to petition the Government to redress grievances.
The Third Amendment: Prohibiting the quartering of solders in private homes without consent.
The Fourth Amendment: Prohibits unreasonable searches and seizures without probable cause, supported by oath or affirmation.
The Ninth Amendment: The rights of the people are not limited to those mentioned in the Constitution.
There are a lot of laws written by the states that place limitations on our activities limiting our freedoms that in some way or another would also reduce our freedoms that are not covered by the constitution. These would include traffic regulations, building codes, etc. These freedoms would be included in those referred to in the Ninth Amendment. The rights for states to regulate these activities would not be any more or less legitimate than the right for abortion.
